TERMS OF USE

These Terms of Use (“Terms”) govern your access to and use of the MURM website, mobile applications, and related services (collectively, the “Service”) provided by MURMIT TECHNOLOGIES INDIA PRIVATE LIMITED (“MURM”, “we”, “us”, or “our”). By accessing or using the Service you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Service.

1. Eligibility

You must be at least 18 years old to use the Service and to register an account. To act as a Companion (a “Murmer”) on the Service you must be 18 years or older. By registering you represent and warrant that you meet the age requirement and have the legal capacity to form a binding contract.

2. Scope of Service

MURM operates a digital platform that connects individuals for short, outcome-focused human interactions delivered via audio, video, chat, group rooms, or verified in-person experiences through partner venues and events. MURM is a platform and not a provider of professional medical, psychological, legal, or other licensed services unless expressly stated in writing.

3. Accounts & Registration

  • Registration requires a phone number and minimal profile information. Keep your account credentials secure.
  • You are responsible for all activity that occurs under your account. We may suspend or terminate accounts that provide false information or violate these Terms.

4. Single Legal Identity & Notices

All legal notices, disputes, or claims regarding the Service must be made against MURMIT TECHNOLOGIES INDIA PRIVATE LIMITED at legal@murm.social and/or the registered office address above.

5. User Roles

  • Users: individuals who use the platform to connect, attend sessions, or join events.
  • Companions / Murmers: individuals accredited by MURM to host 1:1 or group sessions (subject to KYC and training).
  • Partners: third-party venues, cafés, enterprises, universities or organizers that partner with MURM to host events, offer credits, or integrate services.

Each role has obligations described in these Terms, the Companion Code of Conduct (for companions), and Partner Terms (for partners).

6. Partner Relationships (summary)

Partner venues and organizations enter separate agreements with MURM that describe revenue share, café-credit arrangements, redemption and settlement processes, event responsibilities, and liability allocation. Partners must comply with local laws, ensure safe public spaces, and follow MURM’s venue playbook. MURM may suspend partner integrations for safety or policy violations.

7. Booking, Payments & Credits

  • Session and event pricing are displayed in-app. Payment is processed via our payment provider. MURM does not store full card data.
  • Partner credits (e.g., café credit) and their terms will be displayed at booking and are governed by the relevant Partner Agreement.
  • All fees are non-refundable except as provided in the Refund & Cancellation Policy or required by law.

8. Matching, Anonymity & Transparency

  • MURM uses algorithmic and human-assisted matching. Availability varies by locality.
  • Users are anonymous to strangers by default. Minimal contextual signals (language, lair preference, verification badge) are shown to explain matches.
  • Sessions or events run by partners, creators, or paid hosts will be clearly labeled.

9. Safety & Prohibited Conduct

You agree not to:

  • solicit or offer sexual services, prostitution, or sexual favors;
  • harass, threaten, abuse, exploit, doxx or intimidate others;
  • impersonate others or falsify identity; or
  • attempt to circumvent safety, KYC, or moderation systems.

Violations may result in warnings, suspension, permanent termination, refund actions, and legal referral.

10. Intellectual Property

  • You retain rights to your user-generated content. By submitting content you grant MURM a worldwide, non-exclusive, royalty-free license to operate, host, anonymize, and display that content as necessary to provide the Service, to enforce safety policies, and to use anonymized content for marketing and research with consent.
  • Do not upload content that infringes third-party intellectual property rights.

11. Session Recording & Use of Content

  • Sessions are not recorded by default. Recording or transcription requires explicit, session-level consent from all participants; consent is logged.
  • Anonymized clips may be used for marketing with explicit consent.

12. Refunds, Cancellations & No-shows

See the Refund & Cancellation Policy for full details. Partner and IRL costs (food, drinks, venue purchases) are typically the responsibility of participants unless otherwise specified at booking.

13. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” MURM DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MURM’S AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO MURM IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM, OR INR 5,000, WHICHEVER IS LOWER. IN NO EVENT SHALL MURM BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

15. Indemnification

You agree to indemnify MURM against claims arising from your breach of these Terms, your misuse of the Service, or your violation of applicable law.

16. Termination

MURM may suspend or terminate accounts for policy violations, safety incidents, or legal reasons. Users may close their account at any time; certain data may be retained for legal compliance.

17. Governing Law & Dispute Resolution

These Terms are governed by the laws of the jurisdiction where MURMIT TECHNOLOGIES INDIA PRIVATE LIMITED is incorporated. Legal notices should be sent to contact@murm.social or the registered office address above. (Insert preferred dispute resolution clause/arbitration language per legal counsel if required.)

18. Changes to Terms

We may modify these Terms. Material changes will be communicated by email or in-app notice. Continued use after notice indicates acceptance.

REFUND & CANCELLATION POLICY

Sessions & Bookings

  • Instant match failure: If a booked session fails to start due to technical or matching errors, the user will receive a full credit or refund.
  • Early escalation: If a user escalates within the first 5 minutes due to misconduct or safety, MURM may issue a full refund or credit pending investigation.
  • No-shows: If a Companion does not start the session, a refund or credit is provided. If a user does not join a scheduled session without timely cancellation, a charge may apply.
  • Scheduled cancellations: Users must cancel scheduled sessions at least 2 hours before start time for a full refund. Late cancellations may incur a partial charge.

Partner / IRL Costs

MURM fees cover the connection session only. Food, drinks, transport or venue purchases are typically the responsibility of attendees unless specified at booking (partner-credit models). Partner credit programs include redemption terms visible at booking.

Disputes & Chargebacks

Disputes handled in line with payment provider policies. MURM may suspend accounts during investigations.
